ברוכים הבאים לאתר שלנו המופיע בכתובת https://rova4tlv.com/ ו/או בכל פלטפורמה אחרת (כולם ביחד יקראו- "האתר"), והמופעל על ידי עומר ברגמן ("אנחנו").

שימו לב! השימוש באתר כפוף לאמור בתנאי השימוש, ומעיד על הסכמה לתנאי השימוש. אם אינך מסכים לכל הוראה המופיעה כאן עליך לחדול מיד מלעשות שימוש באתר.

בעצם ביצוע כל פעולה ו/או שימוש באתר, הנך מצהיר כי קראת את תנאי השימוש בעיון לפני ביצועה, והנך נותן את הסכמתך לכל הוראותיו ותנאיו, וכי לא תהא לך או למי מטעמך כל טענה ו/או דרישה בכל הקשור לתנאי השימוש.

תנאי השימוש נערכו בלשון זכר, אך הם מיועדים לגברים ונשים כאחד.

1. כללי

1.1 באתר ניתן למצוא מידע ונתונים אודות שירותים ומוצרים שונים שאנחנו ו/או צדדים שלישים מספקים. כך למשל, השירותים שלנו כוללים הנגשת מידע תכנוני ואחר בקשר לרובע 4 בתל אביב, פרויקטי נדל"ן, התאמת הצעות רלוונטיות והעברת פניות של מתעניינים לקבלנים, יזמים וגורמים מקצועיים רלוונטיים בתחום הנדל"ן ("השותפים העסקיים") וכל שירות אחר כפי שיהיה זמין באותה עת באתר ("השירותים").

1.2 אנחנו שומרים לעצמנו את הזכות לעדכן את תנאי השימוש מעת לעת, לפי שיקול דעתנו הבלעדי וללא צורך בהתראה מראש. כל עדכון בתנאי השימוש יחולו מרגע פרסומו באתר (בגרסה העדכנית בכל רגע נתון) ויחול גם רטרואקטיבית על כל מי שעושה שימוש באתר. מוצע לך להתעדכן בשינויים אלה לעיתים קרובות.

1.3 מטרת תנאי השימוש הינה להסדיר את היחסים בין האתר לבין כל גוף ו/או ישות ו/או גורם או מי מטעמם של אלה אשר עושה שימוש באתר ("המשתמש", "אתה" או "הנך").לעניין תנאי שימוש אלה, "שימוש אוטומטי" משמעו כל שימוש באתר שאינו נעשה באופן ישיר על ידי אדם, לרבות שימוש באמצעות תוכנות, סקריפטים, בוטים, סוכנים, כלי בינה מלאכותית או כל אמצעי טכנולוגי אחר.

1.4 תנאי השימוש יחולו על השימוש באתר בכל מחשב או מכשיר תקשורת אחרת שהמשתמש ימצא לנכון לעשות בו שימוש (למשל, טלפון סלולרי, טאבלטים, מחשבים ניידים וכיוצ"ב).

1.5 אנחנו עשויים לעדכן מעת לעת את הטכנולוגיות, הממשקים והפונקציונליות של האתר. המשתמש מסכים כי תנאי שימוש אלה יחולו על כל גרסה עתידית של האתר, אלא אם כן נקבע אחרת בתנאי השימוש המעודכנים.

2. זכות השימוש

2.1 השימוש באתר ובתכנים בו הינו שימוש כמות שהוא (AS IS) ועל בסיס זמינות (AS AVAILABLE) ולא תהיה לך כל טענה, תביעה או דרישה כלפינו ו/או מי מטעמה בגין תכונות האתר והתכנים, נכונות התכנים, שלמותם, עדכניותם ודיוקם, יכולותיו של האתר, מגבלות או התאמת האתר והתכנים לצרכיך, לרבות בגין הפסקתם (זמנית או קבועה), אי שמירה ו/או אובדן של תכנים, לרבות שנשלחו אליך או על-ידך, כמו גם פגיעה או שיבוש בשלמות או בתוכן של תכנים שקיבלת או שיגרת. איננו מתחייבים להעניק תמיכה תכנית לכל תקלה ו/או שיבוש האמורים.

2.2 איננו מתחייבים כי מכלול השירותים המוצעים באתר או שיוצעו בו יוסיפו להיות מוצעים, ויתכן ושירות כזה או אחר יישלל ללא מתן הודעה מוקדמת ובהתאם לדין, לרבות עצם קיום האתר.

2.3 איננו מתחייבים כי השימוש באתר והשירותים הכלולים בו, יהיו ללא הפרעות, הפסקות ו/או חסינים מפני גישה לא חוקית למחשבים שלנו ו/או שיענו על דרישותיך. על אף מאמצים שיעשו, איננו מתחייבים כי כל פגם או ליקוי באתר יתוקנו, ולא נהיה אחראית לכל נזק, ישיר או עקיף, עגנת נפש וכיוצ"ב שעשויים להיגרם לך או לרכושך בשל כך.

2.4 אנחנו רשאים, על פי שיקול דעתנו הבלעדי, לנקוט באמצעים טכניים ומשפטיים למניעת שימוש אוטומטי באתר, לרבות חסימת גישה, הגבלת קצב גישה, או כל אמצעי אחר. אנחנו רשאים להפסיק או להגביל את השימוש באתר של כל משתמש החשוד בהפרת תנאי השימוש, ללא הודעה מוקדמת.

3. פעולות אסורות

לצורך שמירה על האתר, המשתמש, עלינו ועל צדדים שלישים, על המשתמש חל אסור לבצע את הפעולות הבאות:

התחזות לאדם או גוף כלשהו, לרבות נציג, עובד או מנהל שלנו ו/או בעל מאפיין מסוים או מסירת תיאור מסולף או הצגה כוזבת של קשר בינך ובין צד שלישי.
הטענה, שליחה או שידור של כל חומר שקרי ומטעה או חומר אשר נועד להערים על אדם או על גוף כלשהו, במישרין ו/או בעקיפין.
הטענה, שליחה או שידור של כל חומר המכיל כל סוג של וירוס מחשב או כל קוד מחשב אחר, המתוכנן להרוס, להפריע, או להגביל את השימוש (ובכלל זה כל שימוש אחר מלבד שימוש הוגן וסביר בשירות) בכל אחד מן המחשבים, השרתים, החומרה ו/או התוכנה אשר מצויים בשימושנו לצורך אספקת השירותים המוצעים באתר זה. כמו כן אין להפעיל או לאפשר להפעיל כל יישום מחשב או כל אמצעי אחר, ידני או אוטומטי, לרבות תוכנות מסוג רובוט, עכביש, סוכן (agent), זחלן (crawlers) בוטים (bots) וכדומה, לשם כניסה לאתר, איסוף מידע הן בכלל והן באופן שיטתי, חיפוש, סריקה, העתקה, שאיבת מידע (scraping) או אחזור אוטומטי של תכנים מתוך האתר. מובהר כי אין ליצור ואין להשתמש באמצעים כאמור לשם יצירת לקט, אוסף או מאגר שיכילו תכנים ו/או מידע מהאתר.
להשתמש בכלי בינה מלאכותית, למידת מכונה (machine learning), או כל טכנולוגיה דומה לצורך עיבוד, ניתוח, כרייה, סיכום, אימון, כוונון (fine‑tuning) או כל שימוש אחר בתוכן האתר, וכן חל איסור לעשות שימוש בתוכן האתר לצורך אימון, כוונון, העשרה או שיפור מודלים, הכול ללא קבלת הרשאה מראש ובכתב מאיתנו.
הפצת “דואר זבל” (spam) לשרתי האתר או באמצעות האתר, או הפצתם בכל אמצעי דואר אחר.
שינוי, עיבוד, העתקה, שאיבת מידע, התאמה, מתן רישיון משנה, תרגום, מכירה, ביצוע פעולות של הנדסה חוזרת, פירוק או הרכבה מחדש של כל אחד מחלקי הקוד המרכיבים את האתר, לרבות בסיס המידע, וכן פעולות כאלה לגבי החומרה והתוכנה אשר מצויות בשימוש עבור השירות.
פגיעה בכל דרך שהיא בזכויות יוצרים, סימני מסחר, או כל זכות קניינית אחרת אשר מצויה באתר זה, שלנו ו/או של צד שלישי כלשהו.
שימוש שנועד להתחקות אחר אדם אחר או להטריד אדם אחר בכל דרך שהיא.
להעמיס על מי ממערכות האתר או מערכות נוספות שלנו.
לעשות שימוש באתר באופן המפר תנאי שימוש או הסכמים של צדדים שלישיים, או באופן העלול לחשוף אותנו לתביעות או דרישות מצד שלישי.

4. זכות יוצרים

4.1 זכות היוצרים והבעלות לגבי האתר והמידע המופיעים בו, לרבות הפטנטים, המדגמים, השירותים המוצעים באתר, ובכלל זה שם המתחם ("Domain"), זכויות הסודות המסחריים והסימנים המסחריים, עיצובו והאלמנטים הגרפיים המופיעים בו, שייכים לנו. למשתמש שמורה הזכות לשימוש אישי הוגן, בכפוף לתנאי שימוש אלה ולכל דין, ולא לשימוש מסחרי.

4.2 אין להכניס באתר שינויים, להעתיק, להפיץ, לשדר, להציג בפומבי, לבצע בפומבי, לשכפל, לשנות, לעבד, ליצור יצירות נגזרות, לפרסם, למכור, להשכיר או למסור לצד שלישי, בין אם באמצעותך ובין אם באמצעות צד שלישי, כל חלק מן האתר בכל דרך או אמצעי בין אם אלקטרוניים, מכאניים, אופטיים, אמצעי צילום או הקלטה, או בכל אמצעי ודרך אחרת בלא קבלת הסכמה מאיתנו מראש ובכתב.

5. משוב

אנו נשמח לקבל ממך הערות, הצעות ומשוב ביחס לאתר ולשירותים המוצעים בו. עם זאת, מובהר כי כל מידע, שאלה, הערה, רעיון, הצעה, המצאה או חומר אחר שתעביר אלינו בקשר לאתר או לשירותים המוצעים בו (להלן: "משוב") יהיו כפופים להוראות הבאות: (א) מלוא הזכויות במשוב יהיו שלנו; (ב) לא נהיה כפופים לכל חובת סודיות ביחס למשוב, ולא נישא באחריות בגין כל שימוש או גילוי שלו; (ג) נהיה רשאים לעשות במשוב כל שימוש, לכל מטרה, לרבות לצורך פיתוח, ייצור, שיווק ומכירה של מוצרים או שירותים המבוססים על רעיונות, ידע או טכניקות הכלולים בו, והכול ללא תמורה לך או לכל צד שלישי.

באחריותך לוודא כי כל תוכן שתעביר אלינו חוקי ואינו מפר את הוראות הדין ו/או זכויות צד שלישי, וכן שברשותך ההסכמות הנדרשות להעברת תוכן כאמור.

6. קישורים

איננו אחראים לתוכן האתרים שקיימים אליהם קישורים באתר, ולטיב השירות הניתן בהם, ולא נישא באחריות כלשהי בקשר לאתרים אלו. אין לראות בקישורים הקיימים באתר המלצה לשימוש בהם והם מצויים באתר לנוחיות המשתמש בלבד. המשתמש מסכים כי כל כניסה לאתרים אלה וכל התקשרות עם מפעיליהם הינן באחריותו הבלעדית.

7. דואר אלקטרוני

באתר קיימת אפשרות למשלוח דואר אלקטרוני לאתר. לידיעת השולחים, הודעות הדואר האלקטרוני שתגענה אינן חסויות. הן גלויות לעובדים שלנו ועשויות להגיע גם לצדדים שלישיים לצורך טיפול בהן.

8. שיפוי

עם דרישה ראשונה הינך מתחייב לשפות אותנו, עובדינו, נושאי המשרה שלנו, שותפינו, בעלי המניות שלנו, חברות בנות, יועצינו, ספקינו והפועלים מטעמנו בגין כל תביעה, דרישה, נזק, הפסד, אובדן רווח, תשלום או כל הוצאה שייגרמו להם – ובכלל זה שכר טרחת עורך דין (סביר) והוצאות משפט – עקב הפרת תנאי השימוש האלה ו/או הפרת החוק על ידך או על ידי מי מטעמך ו/או תביעה ו/או דרישת צד שלישי כלשהו כתוצאה מכל הפרה של תנאי מתנאי השימוש של האתר.

9. מידע אישי

האתר מעבד מידע אישי כמפורט במדיניות הפרטיות המופיעה כאן. אתה מסכים כי אנחנו רשאים לשמור ולעבד מידע אודות אופן השימוש שלך באתר בין היתר לצורך שיפור השירות, אבטחת האתר ומניעת שימוש לרעה, בכפוף למדיניות הפרטיות.

10. תנאים נוספים

מבלי לגרוע מהאמור, נהיה רשאים לספק נתונים, שירותים ו/או מוצרים נוספים באתר ו/או להפסיק או לבטל כל נתון, שירות ו/או מוצר אשר זמינים כעת, או אשר יהיו זמינים באתר בכל עת בעתיד. כמו כן, עומדת לנו הזכות לקבוע תנאים נוספים/חלופיים אשר יחולו על כל נתון, שירות ו/או מוצר, נוכחיים או עתידיים, שיהיו זמינים באתר ("תנאים נוספים"). אלא אם כן צוין אחרת, התנאים הנוספים ייחשבו כחלק בלתי נפרד מתנאי השימוש. במקרה של סתירה בין תנאי השימוש הכלליים לבין תנאים נוספים ספציפיים, יגברו התנאים הנוספים הספציפיים.

11. אחריות

11.1 איננו אחראים בצורה כלשהי לפגמים ו/או ליקויים ו/או טעויות מכל סוג, במידע שמופיע באתר.

11.2 איננו אחראים בצורה כלשהי, ישירה או עקיפה, לכל נזק ו/או הפסד, ישיר או עקיף, הנובע משימוש באתר ו/או בתכניו ו/או בשירותים או הנובע מאי יכולת להשתמש באתר, ו/או מהורדת תכנים מהאתר מכל סיבה שהיא. כמו כן, לא נישא באחריות בגין נזקי תכנה ונזקים אחרים אם יגרמו כתוצאה מהשימוש באתר.

11.3 איננו מתחייבים כלל כי האתר ו/או השימוש בו, עונים או יענו על צורך כלשהו של המשתמש, ולא נישא באחריות להתאמת המידע לצרכי המשתמש.

11.4 שימוש במידע המצוי באתר אינו מהווה תחליף לקבל יעוץ ו/או טיפול משפטי, מקצועי או אחר, בכל תחום, והסתמכות על האמור בו היא באחריות המשתמש בלבד. אין לעשות שימוש במידע באתר ללא הפעלת שיקול דעת מקצועי ובלא בדיקה של המידע.

11.5 במידה ויש סתירה בין המידע המצוי באתר ובין חומר המתפרסם בפרסומים הרשמיים, החומר בפרסומים הרשמיים הוא הקובע, ועליו יש להסתמך.

11.6 מבלי לגרוע מהאמור ובהתאם למגבלות הקבועות בדין, גם אם ימצא כי אנחנו ומי מטעמנו אחראים לנזק כלשהוא, סכום הפיצוי והסעד הבלעדי של המשתמש ביחס לכל מחלוקת הקשורה לאתר ו/או לתוכן בו ו/או לשירותים יוגבלו לסכום ששולם לנו על ידי המשתמש עבור שימוש כאמור (ככל ששולם).

11.7 לא נישא באחריות לאי-ביצוע או עיכוב בביצוע התחייבויותינו אם אי-הביצוע או העיכוב נובעים מנסיבות שאינן בשליטתנו הסבירה, לרבות אסונות טבע, מלחמות, תקלות תקשורת, הפסקות חשמל או אירועי כוח עליון אחרים.

12. שימוש בבינה מלאכותית

החברה עשויה להפעיל באתר צ'אט בוט (Chat Bot) שנועד לספק תמיכה ושירות בנושאים הקשורים לשירותי האתר, והשימוש בו מוגבל לשאלות ו/או בקשות מקצועיות ואשר קשורות לשירותים בלבד, ואין להשתמש בו לשיחות אישיות או לא מקצועיות. אתה אחראי באופן מלא לכל שיחה או תקשורת המבוצעת דרך הצ'אט בוט, ועליך להימנע מהעלאת תכנים פוגעניים, תוקפניים, שקריים או כאלה המפרים את תנאי השימוש של האתר. הצ'אט בוט מיועד לספק מענה מהיר לשאלות, אך איננו מתחייבים לספק מענה מידי לכל פנייה, ויתכן שיידרש זמן מסוים לקבלת תשובה. אנחנו שומרים לעצמנו את הזכות להפסיק שיחה בצ'אט בוט בכל מקרה של התנהגות לא ראויה או מפרת כללים, ובכלל זה שימוש בשפה פוגענית, הצפת שיחות או כל פעולה הנחשבת להטרדה. יובהר כי הצ'אט בוט עשוי לכלול מענים אוטומטיים שנועדו להנחות את המשתמשים או להשיב על שאלות נפוצות, וכי השימוש בו אינו מהווה התחייבות לקבלת מענה אישי לכל שאלה.

13. קטינים

השימוש באתר מיועד לבגירים בלבד. הנך מאשר בזאת כי מלאו לך 18 שנים. אם אינך עומד בדרישות הגיל המפורטות כאן, הנך מתבקש לחדול מכל שימוש באתר ולצאת ממנו באופן מידי.

14. זכויות

כל שיהוי שלנו בקיום זכות המגיעה לנו או אי עמידה שלנו על זכות המגיעה לנו לפי תנאי השימוש אלו או על פי דין, הינה לפנים משורת הדין בלבד ולא תשמש או תיחשב כוויתור שלנו על זכות כאמור.

15. שונות

15.1 אם ייקבע בפסק דין או בהחלטה שיפוטית סופי/ת וחלוט/ה כי אין תוקף לחלק כלשהו במדיניות הפרטיות, יהא בטל אותו חלק בלבד וכל שאר חלקי מדיניות הפרטיות יעמדו בתוקפם וימשיכו לחייב אותך. אתה מסכים כי יש ליתן למדיניות הפרטיות את הפרשנות והתחולה הרחבים ביותר על מנת לקיימם או כל חלק מהם.

15.2 הדין החל בכל הנוגע לתנאי שימוש אלה ופרשנותם הינו הדין הישראלי (ללא התחשבות בכללי ברירת דין), כמו-כן, לבית המשפט המוסמך בעיר תל אביב-יפו תהיה סמכות השיפוט הייחודית והבלעדית בכל הקשור לתנאי שימוש אלה.

מדיניות פרטיות זו ("מדיניות הפרטיות") חלה על האתר שכתובתו https://rova4tlv.com/ ועל דפי נחיתה, טפסים, ערוצי תקשורת ושירותים מקוונים קשורים (ביחד: "האתר"), המופעלים על ידי עומר ברגמן ("אנחנו" או "אנו"). השירותים שלנו כוללים פלטפורמה טכנולוגית ושיווקית המקשרת בין מתעניינים לבין קבלנים ו/או צדדים שלישיים נוספים בתחומי הנדל"ן ונושאים הקשורים לכך ("קבלנים") הנגשת מידע תכנוני ואחר בקשר לרובע 4 בתל אביב, פרויקטי נדל"ן ("פרוייקטים"), התאמת הצעות רלוונטיות והעברת פניות של מתעניינים לקבלנים, יזמים וגורמים מקצועיים רלוונטיים בתחום הנדל"ן ("השותפים העסקיים") וכל שירות אחר כפי שיהיה זמין באותה עת באתר ("השירותים"). מובהר כי האתר אינו ספק השירות בפועל של השירותים. מטרת האתר היא איסוף פניות ("לידים") והעברתן לקבלנים רלוונטיים תמורת תשלום או כחלק משיתוף פעולה עסקי, כמפורט במדיניות זו.

מדיניות זו מסבירה איזה מידע אישי נאסף במסגרת השירותים, לאילו מטרות הוא מעובד, למי הוא עשוי להימסר ומהן זכויותיך. אין חובה חוקית למסור לנו מידע אישי; מסירתו תלויה ברצונך ובהסכמתך. אולם, ללא הפרטים הנדרשים לא נוכל לטפל בפנייתך, להתאים לך מידע, הצעות או להעביר את פנייתך לשותפים העסקיים הרלוונטיים, בכפוף להסכמתך.

1. מהו מידע אישי וכיצד הוא נאסף?

מידע אישי הוא נתון הנוגע לאדם מזוהה או לאדם הניתן לזיהוי ("מידע אישי").

ככל שהנך מוסר מידע אישי עבור ו/או בשם צד שלישי אתה מתחייב בזאת כי הנך מוסמך ובעל הרשאה כדין למסור את המידע האישי אודות אחר וכי מסירת המידע נעשתה לאחר קבלת הסכמתו למסירת המידע אלינו בהתאם למדיניות פרטיות זו, והדבר אינו פוגע בזכויות של צד שלישי ו/או בפרטיותו.

1.1 הצגת הפרוייקטים - על מנת לקבל מאיתנו את רשימת הפרוייקטים לטלפון הנייד, נבקש ממך למסור לנו את הפרטים הבאים - שם מלא, מספר טלפון, אימייל (אינך חייב), העדפותיך הרלוונטיות לפנייה וכל מידע נוסף שתבחר למסור.

1.2 התאמת הפרוייקטים - על מנת שנוכל לסייע לך במציאת הפרוייקט המתאים ביותר עבורך, נבקש ממך למסור לנו את הפרטים הבאים – סוג הדירה אותה בה אתה מתעניין, מספר חדרים, זמן לאכלוס, האם יש צורך בחניה, תקציב וכל מידע נוסף שתבחר למסור.

העברת פניות לשותפים עסקיים ומתן שירותי דיוור ישיר – כמו כן, ומבלי לגרוע מהאמור במדיניות זו, אם תבחר למסור פרטים בטופס המיועד לקבלת מידע, הצעה או יצירת קשר בקשר לפרויקט או לשירות, ובהתאם להסכמה שתתבקש לתת בטופס, החברה עשויה להעביר את פרטיך, את תוכן פנייתך והאם התעניינת בפרוייקטים נוספים לקבלנים, יזמים, משווקים או גורמים מקצועיים רלוונטיים בתחום הנדל"ן, כדי שיוכלו ליצור עמך קשר ולספק לך מידע, הצעה או שירות שביקשת. נוסח ההסכמה יפרט באופן ברור את קטגוריות מקבלי המידע.

4.5 לצורך מניעת תרמית, אבטחת מידע, הגנה על משתמשים ועל נכסים, או עמידה בחובות חוקיות.

5. דיוורים ופרסומים

5.1 ככל שהסכמת לקבל הודעות שיווקיות, דבר פרסומת, הודעות בדיוור ישיר ו/או הודעות אחרות מהחברה ("הודעות שיווקיות"), אנו, בסיוע צדדים שלישיים, נשלח אליך מדי פעם הודעות שיווקיות שעשויות לכלול עדכונים, הצעות, הטבות ומבצעים, באמצעים דיגיטליים שונים, לרבות דוא"ל, תוכנות לשליחת מסרים מיידיים (כגון צ'אט ו-WhatsApp) והודעות SMS.

5.4 בכל עת תוכל/י לחדול מלקבל הודעות כאמור, באמצעות לחיצה על קישור "הסרה" באחת מתכתובות הדוא"ל שהגיעו אליך מהחברה, בכל אמצעי אחר שיצוין בהודעה, בהתאם לדרישות הדין, וכן באמצעות שליחת דוא"ל לכתובת: info@rova4tlv.com. מובהר כי גם לאחר ההסרה, החברה תמשיך לשלוח הודעות תפעוליות.

Our services include a technological and marketing platform that connects interested parties with contractors and/or additional third parties in real estate and related fields ("Contractors"), access to planning and other information about Quarter 4 in Tel Aviv and real estate projects ("Projects"), matching relevant offers and referring inquiries from interested parties to contractors, developers and relevant real estate professionals (the "Business Partners"), and any other service available on the Site from time to time (the "Services"). It is clarified that the Site is not the actual provider of the Services. The purpose of the Site is to collect inquiries ("Leads") and refer them to relevant Contractors in return for payment or as part of a business collaboration, as described in this policy.

Referring inquiries to Business Partners and providing direct mailing services - in addition, and without derogating from this policy, if you choose to provide details in a form intended for receiving information, an offer or contact regarding a Project or service, and in accordance with the consent you will be asked to give in the form, we may pass your details, the content of your inquiry and whether you were interested in additional Projects to contractors, developers, marketers or relevant real estate professionals, so that they can contact you and provide the information, offer or service you requested. The consent wording will clearly specify the categories of recipients.

1.3 Personal Information about you that we receive from developers - details of the transaction you closed with them, including the name and location of the property, number of rooms, price and any other information that came up in conversation between you that you chose to provide to them and that they provided to us.
